ANNOUNCEMENT AND CALL FOR PAPERS

LAW IN A TRANSFORMING SOCIETY

Venue: Sunnyside Campus, Unisa,

Pretoria, South Africa

The Palace of Justice, where the cocktail function will take place.

BACKGROUND

THEME

The theme for the conference is: Law in a transforming society.  There can be little doubt that South African society has gone through a fundamental transformation in the past ten years.  However, most societies are always in a process of change and transformation.  In many ways, these changes have necessarily been undertaken swiftly and pragmatically.  There has been little opportunity to assess the changes or their social impact in a fundamental and systematic fashion.

Therefore, it should not be inferred that the conference is limited to South African developments and history.  Throughout history transforming societies have posed unique problems and insights.  It is envisaged that papers presented at the conference will deal with this broad theme rather than be restricted to the South African context.

While two plenary sessions will be held, the main body of the conference will consist of four "streams" or sessions as set out below.

Stream 1:  The sources of law

It is almost inevitable that, in a transforming society, the sources of law will also be re-evaluated.  Papers in this sub-theme should therefore concentrate on studies of both traditional and non-traditional sources of law.

Stream 2:  Philosophical and critical views on law

Recent years have seen profound shifts in legal philosophy, both internationally and in South Africa.  Papers in this sub-theme should therefore focus on the philosophical underpinning of law in a transforming society.

Stream 3:  Legal changes and challenges

Because changes in the legal system are often the result of political and/or policy considerations, they tend to happen in a haphazard and unsystematic fashion.  Papers in this sub-theme should aim at placing these changes within a certain context or system and to engage critically with these changes.

Stream 4:  The transforming society

In a transforming society, legal changes affect society and vice versa.  Papers in this sub-theme will probably be both empirical and theoretical and the interdisciplinary aspect is obvious.

SUBMISSION OF ABSTRACTS

All abstracts will be subject to a peer-review process before being accepted for the conference.  To facilitate this process, abstracts should be submitted before 15 October 2005.  Abstracts can be submitted electronically in MSWord to kroezij@unisa.ac.za or mailed to:  Prof IJ Kroeze, PO Box 392, Unisa, 0003.  Abstracts should not exceed 400 words.
